Financial Management Course Submission Requirements

FINANCIAL MANAGEMENT COURSE SUBMISSION REQUIREMENTS 

Overview:

Every individual debtor in a Chapter 7, Chapter 13, or Chapter 11 case must comply with the requirements of Fed. R. Bankr. P. 1007(b)(3) concerning the completion of a financial management course. This requirement can be satisfied if either: (i) the financial course management provider directly submits to the court the course completion certification; or (ii) the debtor submits official Form B423 (“Certification About a Financial Management Course”). In a Chapter 7 case the certification is due within 60 days of the date first set for the meeting of creditors under Section 341 of the Bankruptcy Code.  In a chapter 13 case, it must be filed no later than the last payment made by the debtors as required by the plan or the filing of a motion for entry of a discharge under Section 1328(b) of the Code.  In a Chapter 11 case, it must be completed and filed within 45 days after the first date set for the meeting of creditors under Section 341 of the Bankruptcy Code.  If a joint petition is filed, each spouse must individually satisfy this requirement.
